01What this site is

This project compares what each New Jersey jurisdiction certified to the State about opioid settlement money against the ledger that jurisdiction keeps. It publishes both records, the arithmetic between them, and a grade produced by code from a published rubric. There is nothing to sign in to and nothing to buy.

Reading a page, downloading the data or calling the read only interface means accepting the terms on this page. If you do not accept them, do not use the site.

02The documents

Every document here was produced by a government body, either through the Open Public Records Act or through the State reporting system. Each is reproduced as it was produced, with the title the body gave it, the date it was printed, the account it covers and the page. A document is never edited, and a figure never appears without the document and page it came from.

A public record is not withdrawn from this site because a subject would prefer it were not public. Where a production carries identifying detail about a member of the public, that detail is withheld before the document publishes. Nothing else is removed.

03Intellectual property

Three different things live on this site and they carry three different terms. The published data may be reused with credit. The source documents carry no terms from this project, because they were public before this project touched them. The site copy and the code are reserved.

The data
The published rows, grade inputs and document identifiers may be quoted and republished with credit to Opioid Audit and the document identifier and page the figure came from.
The attribution
Credit Opioid Audit, and keep the document identifier and page beside any figure you republish, so your reader can resolve the figure to the record it came from.
The documents
Source documents are public records produced by government bodies. They are reproduced here as produced, under no license of ours, because a public record is already public.
The site itself
The design, the code and the written analysis are reserved. Quote them with credit. Do not republish a page whole as your own work.

04No warranty

A figure on this site is warranted only as an accurate reading of the document cited beside it. This project does not warrant that a government record is itself accurate or complete. This project does not warrant that the site is available, uninterrupted or free of error, and the site and the data are offered as they are.

Grades are computed from published rows by a published rubric, applied by code the same way for every jurisdiction. A grade is a result, not an opinion about anyone. Decisions made from this data are the responsibility of whoever makes them.

05Limitation of liability

To the fullest extent the law allows, this project is not liable for any indirect, incidental, consequential, special or punitive loss arising from the site, the data or the interface, including lost profit, lost opportunity and reputational harm. This applies however the claim is framed, whether in contract, in tort or otherwise, and whether or not this project was told the loss was possible.

Nothing here limits a liability that cannot be limited under New Jersey law. There are no fees for anything on this site, so there is no payment against which a cap could be measured.

06Acceptable use

  • Automated collection that degrades the service for other readers.
  • Presenting a figure or a grade as a characterization by this project. The pages state what a document says and what an account shows, and nothing more.
  • Republishing a figure stripped of the document identifier and page that resolve it.
  • Using the site or the data to harass a public employee, or to attach a person to a finding that is about a jurisdiction.
  • Framing a page inside another site in a way that misstates who published it, or presenting this work as endorsed by a body that has not endorsed it.

An automated client is treated as an extension of the person running it. You are answerable for every request made under your control. Attempting to break, overload or gain unauthorized access to the site, its store or its database is prohibited.

07What you send to this project

When you send a correction, a jurisdiction response, a tip, a media question or a document through a form on this site, you grant this project a perpetual, irrevocable, worldwide, non exclusive, royalty free license to publish it, in whole or in part, in any medium, and to keep it as provenance for the record it supports. You warrant that you had the right to send what you sent. Publication is never promised.

Nothing sent to this project is legally confidential or privileged. There is no reporter shield you can rely on here and no undertaking that could survive a lawful demand. This project does not name a tip sender on the site, which is a practice rather than a legal protection.

08Links to other sites

This site links to State systems, jurisdiction sites, court dockets and other public sources. This project does not control any of them and is not responsible for what they contain, what they collect or what they do next. Their terms and their privacy policies govern your visit, not these terms.

09Children

This project does not knowingly collect personal information from anyone under 13, and where a framework sets the threshold at 16 this project treats 16 as the floor. Nothing on this site is directed to children. If you are under that age, do not send anything through a form on this site.

If information from a child reaches this project anyway, it is deleted. Write through the contact form.

10Governing law and venue

These terms are governed by the law of the State of New Jersey, without regard to conflict of law rules. Any dispute arising from the site, the data or these terms belongs in the state or federal courts sitting in New Jersey, and both sides submit to that jurisdiction.

There is no arbitration clause here and no waiver of any collective remedy. A reader who has a claim against this project keeps the forum the law gives them.

11Changes to these terms

These terms may change. A changed version carries a new version number and effective date at the top of this page. No term on this page is edited in place without that record.

12Copyright claims

Source documents on this site are public records produced by government bodies. A claim of copyright over one of those is unlikely to succeed. Where material other than a government record is claimed, the claim is read and answered.

A complete claim names the page and the document identifier, the material claimed, the basis of the claim, and includes a statement made under penalty of perjury that the claim is accurate and made by the rights holder or an authorized agent. Send it through the contact form. A designated agent registration for the statutory notice and takedown safe harbour has not yet been filed.

A copyright claim is not the way to dispute a figure. Send the record that shows the figure is wrong.

13Contact

Notices under these terms, license questions, copyright claims and service of legal process all go through the contact form and the project mailbox. A reply comes from the project mail domain, never from a personal address. Nothing on this page is legal advice, and nothing here waives a right or a defence available to this project.

Opioid Audit

Opioid settlement money was meant for treatment and recovery. New Jersey towns spent it on Flock cameras, surveillance drones, police gear, and told the State it went to programs that do not exist. We found it in their own ledgers, town by town, and we are publishing all of it with the pages cited. This is fraud, documented, and it is now public.
