Fake encumbrances
The report certifies money as encumbered, meaning committed to an order or contract. The books show no open commitment behind it.

Each town reports on the State's form and keeps the records behind its spending for five years, so the spending can be verified.

Funding-source substitution
Work a town used to pay from another fund is moved onto the opioid account. The other fund's line is not reduced.

Police vehicles, upfits, body armor and equipment paid from the opioid account.

Section D(2) requires the money to go to opioid remediation. Police vehicles and equipment are not among the uses Exhibit E Schedule B lists, and no evidence based overdose program built on them is documented. These purchases usually replace capital a town funded from its own budget, which N.J.S.A. 26:2G-39(f) bars.

Surveillance technology
License plate readers, cameras and the subscriptions behind them, paid from the opioid account.
What the agreement says
Section D(2) requires the money to go to opioid remediation. License plate readers and cameras are not among the uses Exhibit E Schedule B lists, and no evidence based program that uses them to treat or prevent opioid use is documented. Where a town paid for the same system before, the purchase replaces local money, which N.J.S.A. 26:2G-39(f) bars.

Year-end salary reclass
At fiscal year end, a journal entry moves salary off the salary line and onto the opioid account.

Section D(7) bars using the money to reimburse a town for past expenditures. It has to add to local spending, not replace it.

Zero certification
